1. Acceptance of Terms

By accessing or using samāgama.ai, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and our Cookie Policy. These Terms constitute a legally binding agreement between you and samāgama.ai. We may update these Terms from time to time, and will notify you of material changes via email at least 30 days in advance. Continued use after changes take effect constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use samāgama.ai. By creating an account, you represent and warrant that you are 18 or older, that you have the legal capacity to enter into these Terms, and that the information you provide during registration is accurate and complete.

We reserve the right to request age verification at any time and to suspend or terminate accounts that we reasonably believe belong to individuals under 18.

3. Your Account

When you create an account with samāgama.ai, you agree to the following:

• One account per person - each individual may maintain only one account. Creating multiple accounts to circumvent restrictions or manipulate the matching system is prohibited.
• Account security - you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
• Accurate information - you agree to provide truthful and accurate information during registration and to keep your account information up to date.
• Non-transferable - your account is personal to you and may not be transferred, sold, or shared with any other person.

4. Subscription & Payment

samāgama.ai may offer subscription plans or paid add-ons that provide access to different tiers of the Service. If billing is not enabled in the app, no payment method is collected and no paid subscription is active. When paid plans are enabled, the following terms apply:

• Subscription plans - details of available plans, including pricing, features, and session limits, are displayed on our pricing page and may be updated from time to time. Changes to pricing will not affect your current billing period.
• Auto-renewal - paid subscriptions renew automatically at the end of each billing cycle (monthly or annual) unless you cancel before the renewal date. You will be charged the then-current subscription fee upon renewal.
• Cancellation - you may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.
• Refunds - if you cancel within the first 14 days of a new subscription or renewal, you may request a prorated refund for the unused portion of your billing period. After 14 days, no refunds will be issued, but you will retain access through the end of your paid period.
• Payment processing - when paid plans are enabled, payments are processed by our third-party payment provider. We do not store your credit card number or banking details on our servers.

5. Acceptable Use

You agree to use samāgama.ai responsibly and in accordance with these Terms. The following conduct is prohibited:

• Harassment - attempting to use the platform to generate abusive, threatening, hateful, or discriminatory content, whether directed at AI personas or at other users through any shared features.
• Jailbreaking - attempting to manipulate, bypass, or circumvent the safety guardrails, system prompts, or behavioural boundaries of AI personas.
• Impersonation - representing yourself as another person, or misrepresenting your identity or affiliation in any way.
• Automated access - using bots, scrapers, or automated tools to access the Service, send messages, or extract data without explicit written permission.
• Illegal activity - using the Service for any purpose that violates applicable laws or regulations.
• Reverse engineering - attempting to reverse engineer, decompile, or extract the source code, prompts, or algorithms of the Service or its AI personas.

Violations may result in immediate suspension or termination of your account.

6. AI Personas

samāgama.ai features a growing library of AI personas, each with a distinct name, personality, schedule, and conversational style. By using the Service, you acknowledge and agree to the following:

• AI, not human - every persona on samāgama.ai is an artificial intelligence. They are not real people. While they have names, backstories, and consistent personalities, they are AI-generated characters powered by large language models.
• Not professional advice - personas do not provide medical, legal, financial, or therapeutic advice. Any information shared by a persona is for conversational purposes only and should not be relied upon for professional decision-making. If you need professional help, please consult a qualified human professional.
• Romantic and emotional content - some personas may engage in romantic or emotionally intimate conversation within defined boundaries. This is a feature of the platform, not a flaw. However, all such interactions are subject to safety guardrails. Explicitly sexual content is not permitted and will not be generated by any persona.
• Persona behaviour - personas may set boundaries, decline requests, or temporarily reduce engagement if they detect patterns of harmful behaviour. This is by design and reflects our commitment to healthy interaction patterns.

7. Content & Data

• Your data - you own the content you create on samāgama.ai, including your messages and profile information. You can export or delete your data at any time.
• Service licence - by using the Service, you grant us a limited, non-exclusive, non-transferable licence to process your data solely for the purpose of operating and improving the Service. This licence terminates when you delete your account.
• Encryption - all personal and conversational data is encrypted at rest using AES-256 column-level encryption. See our Privacy Policy for full details.
• No training - we do not use your private conversations to train AI models.

8. Reporting & Moderation

We take the safety and well-being of our users seriously:

• User reports - you can report any concerning interaction or content through the in-app reporting feature. All reports are reviewed by our team.
• Persona safeguards - AI personas are equipped with behavioural safeguards and may temporarily set boundaries, redirect conversations, or reduce engagement if they detect patterns that could be harmful to the user.
• Admin review - reported interactions are reviewed by human moderators. If a violation is found, appropriate action will be taken, ranging from a warning to account termination depending on severity.
• Well-being resources - if a persona detects signs of distress or crisis, it will provide relevant helpline and support resources as appropriate for the user's region.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• samāgama.ai is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service's availability, reliability, accuracy, or fitness for a particular purpose.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to emotional distress, loss of data, or loss of revenue.
• Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
• AI personas may occasionally produce inaccurate, inconsistent, or inappropriate responses. We are not liable for the content generated by AI personas, and you use the Service at your own discretion.

10. Termination

• By you - you may delete your account at any time from your account settings. Deletion is permanent. All personal data, conversations, and relationship signals will be erased after the 72-hour grace period. If paid subscriptions are active, they will be cancelled or handled according to the payment provider process, and any applicable refund will be processed per our refund policy.
• By us - we may suspend or terminate your account if we reasonably determine that you have violated these Terms, engaged in abusive behaviour, or pose a risk to the safety of other users or the integrity of the Service. We will notify you of any suspension or termination via email, along with the reason for the action.
• Effect of termination - upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Governing Law, and any accrued obligations) will continue to apply.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in your country of residence. Any disputes arising from or relating to these Terms or your use of the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration in accordance with the applicable rules in your jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
